In other words, more and more family businesses will have to hand the reins after succession not to someone in the family but to an outside professional. That is not a “failure” — but nor should it be an “obligation” caused by nobody in the family having been prepared.

Before It Becomes a Legal Matter
Not every dispute has to be taken to court. Sometimes, before any legal process begins, a space can be made in which the parties can hear each other again.
By putting rights, needs, interests and likely outcomes on the table, a settlement-focused solution can be sought.
My approach is not to remove conflict at any cost. It is to find the best outcome available.
